I sincerely wish that there would not be a need for this letter of opposition. However, I have <br />received notice the Platte Sand & Gravel= LLC has aQptied for an amendment to their M.L.RB. Permit #2000-158. '~ <br />Specifically, Platte Sand 6t Gravel, LLC has requested m amendment to their origins! permit that would allow for <br />them to change the'v operation from a wet mining project to a dry mining project. This proposed amendment has <br />serious ramifications for those of us who are immediate, geographical neighbors of this property, and I must <br />respectfully request that the Mined Land Reclamation 8oerd deny this proposed amendment to the ariginai permit. <br />My reglrest for denial of this amaldment is based on the following concerns that ere not clearly addressed in the <br />proposed amendment: <br />• The paeotiel impacts from dry mining operations to adjacent landowners, domestic wells, 'urigation wells, <br />irrigation ditches and alluvial groundwater use subirrigation. <br />• The amended reclamation plan with rasped to environmelrtal protection of sur~ce wather run-on, runo$ <br />discharge, and goals and exportations. <br />• The preserrx of wetlands that necessitate mitigation and need fora 404 permit from the Corps of Engineers. <br />• The potential loss of wildlife habitat acct delineation of buffer zones to protect the bald eagle winter roost <br />habitat identified by the Colorado Division of Wildlife in 2001. Please reference Division of Wildlife <br />environmental speaalist Mgte Sherman's original reports m this application. These may require significant <br />revision for a proposed dry mining Ilptaafion. <br />• A carefid, prudent review of the l00 year goad plain analysis, mitigation and set back requirements for a dry <br />mining operation. <br />• An appropriate water augurentatien plan from the reclaiaed Take surface and water utilized in theday-today <br />operation of a dry mine. <br />• The containment and disposal for mine and plant generated chemical erect abet mining by-products. <br />• The appropriate lining of reclaimed pits for the proposed use of such pits glr municipal water storage. <br />• The legal right to enter end protection of existing struchlres and easements. Specifically, the praedion of the <br />Ft. Saint Vrain historical site. The Fort's original site is not marked by the existing monument The origins! <br />site can be determined only by trained, professional archeologists who can precisely determine the original site <br />of the Fort and can recanmend the appropriate preservation measures required to maintain the historical <br />integrity ofthe site. <br />• The legs! rite to enter with respect to future exptaration acct development of oi! artd gas leases. <br />• The question of appropriate radrarge structure and test wells to maintain the integrity of the amendment's <br />proposed slurry walls for praection of groundwater supplies. <br />I request status es a `party" to this amendment application <br />Sincerely, ep~ <br />Btuce lZppa~ <br />
