Cattany <br />Division DIreCIOr <br />Na[u21 Resource Trus[ee <br />The Division of Minerals and Geology is in receipt of your letter dated June 24, 3005 clarifying the intentions of <br />L & L Ready Mix with regazd to the maximum area of disturbance at the Sunny Dale Fazm Pit. After further <br />review of the original permit application, the Division has identified that the submitted and approved Reclamation <br />Plan states: "As increments of 3 acres aze completed having the gravel extracted, reclaiming will begin. The <br />banks which have been disturbed will be sloped to a maximum of 3:1 slope. Overburden and dirty gravel will be <br />used if needed to accommodate this. After scarifying the graded slopes, six inches of topsoil will be spread over <br />the disturbed azea. A cover crop of hybrid forage sorghum will be seeded before July 1 at the rate recommended <br />by SCD. Grass seeding will be done between November 1 and May 1 when there is at least 8" to 12" of stubble <br />to seed grass into. The creek channel will not be seeded, as run off would wash away any vegetation which might <br />try to become established... As the mining advances to the west in the creek bed, the sides will be reclaimed at 3 <br />acre increments." (See the enclosed copy of the original Reclamation Plan). <br />Therefore, it appeazs to the Division that the permit specifications prior to the approval of TR-Ol did in fact state <br />that the maximum disturbed, azea would be limited to 5 acres. The approval of TR-Ol increased the maximum <br />allowed disturbance to 25 acres.
