~;. <br />Shaffers Crossing t,uarry Petition to Amend ODP: Extend Allowable limeframe to complete Mining <br />An existing reclamation 110 pennit for this property is on file with and has been approved by the <br />Mined Land Reclamation Board under the Division of Minerals & Geology with the State of <br />Colorado. The permit number is M1978208. This permit is current and active with the State. <br />The original permit was transferred in 1999 from L.N. Properties to Bill Peterson, the current <br />property owner. A copy of transfer of permit and succession of operators application form is <br />attached together with a copy of the most recent DMG annual report. <br />The existing reclamation plan together with the proposed modifications were reviewed by the <br />firm, Bnerly As~iates. Mr. Alan Howard's report (attached under Geological Report? reviewed <br />both the existing geological conditions together with those proposed under the Reclamation Plan. <br />His conclusion is that the proposed slope design and final pit design allows for a sound <br />geomechanical solution to the existing ground control conditions. <br />Initial investigation of existing site conditions revealed that the property had been partially and <br />inconsistently developed and stripped. Highwalls have been left in unsafe conditions with <br />hanging rock and no clear bench development is readily discernible. Recent operations by others <br />have left areas unreclaimed, prone to wash-out and erosion, caused trees to be locally affected <br />causing them to die and restricted critical access to upper parts of the property for emergency <br />vehicles and water storage. <br />Currently the property is utilized in accordance with its light industrial (13) zoning and partially <br />developed. The principal business on site is a septic sewage transfer facility. One building exists <br />which has been historically utilized by a drilling contractor. It currently temporarily houses an <br />exercise facility. Both businesses are under the control of Aspen Enterprises Inc., DBA Aspen <br />Septic ,and the Owner, William "Bill" Peterson, Jr. <br />Future planned development in the area (CDOT, Carter Burgess et aq indigtes future expansion <br />and widening of the 285 corridor affecting the North border of the identified area. The currently <br />proposed schedule indicates that construction is scheduled to begin beM~een 2005 and 2006. <br />The reclamation plan takes into account this activity, environmental impact and accessibility. <br />JC 00639 <br />petersonlElk Creek <br />
