Cottony <br />Glenwood Springs, Colorado 81602 Division Director <br />Natural Resource Trustee <br />RE: Gypsum Ranch Pit~rmit No. M-1998-014, Tom Logue Letter Dated January 12, 2004 ~~ <br />Partial Response to Amendment N/1 Second Adequacy Review <br />Dear Mr. Wood: <br />DMG received the above noted partial response to our second adequacy review letter for Amendment No. 1 <br />to Permit No. M-1998-014. The letter included a request to extend the decision date for this amendment to <br />February 12, 2004. This extension has been accepted. However, be aware that this extension takes the <br />review timeframe for this amendment to the one year mark. If a decision on the application is not finalized by <br />that date, this application will be scheduled for a hearing before the Mined Land Reclamation Board. At that <br />Hearing the Board may deny, or approve the application with or without conditions. <br />Please submit a complete response to the second adequacy review as soon as possible, but no later than <br />February 4, 2004 so the decision due date set for February 12, 2004 can be met. <br />RESPONSE TO REQUEST FOR FOUR ITEMS OF ADDITIONALINFORMATION <br />1. The Exhibit C Sheet 1 of 5 map aerial photograph is a good base map to visually locate different <br />vegetative types. However, identification of the vegetative types, from the photo is difficult. Please <br />delineate the boundaries of, and specify the vegetative community types in the amendment area. ie: <br />grassland, shrubland, wetland /riparian, and woodland /forest communities. If possible, provide more <br />specific identification such as sagebrush shrubland, mixed-mountain shrubland, bunchgrass grassland <br />or pinyon-juniper woodland. <br />2. If this material was included in the grading and sloping calculation, then this is ok. However, it should <br />be noted that this material was included in that figure. Additionally, the average haul/push distance <br />and grade is needed for the material to be used for backfill. Stockpiles in significantly different <br />locations (distance and/or grade) should be calculated and noted separately. <br />3. The Army Corps of Engineers letter was faxed to 434-0676 on January 21, 2004, as requested. <br />4. If the sediment pond will be situated on bedrock, then stability demonstrations must address <br />construction specifications for the portion of the berm that is to serve as the dam for this pond. Sizing <br />and construction details must be calculated to demonstrate the pond is adequate to hold and store the <br />10 year - 24 hour storm event safely. These designs must include any outlet or discharge conveyance <br />structures. The partial response letter indicates that the berm/sediment pond dam will be a maximum <br />six feet high, while the application maps indicate 3 feet high. Please correct this discrepancy.
