[Note: you may write <br />directly to Bruce Smith at his a-mail address above to coordinate a meeting with <br />him.] The Division of Water Resources comments to the DMG for your <br />amendment request was that we need more information in a water supply report <br />before we can assess your water usage to determine if your operation causes <br />injury to any higher priority water rights. <br />Typically, a water rights engineer writes up the report based upon our <br />requirements in Policy 2003-2 (link attached below). However, your project may <br />be simple enough that you will be able to do the work yourself. You will need to <br />provide us with a description of all activities that use water. From your file, I <br />would assume that at the least, you have evaporation losses caused by the surface <br />area of exposed water and from washing of the gravel you extract. Our office <br />would accept 38"/year surface water evaporation for your location. The policy <br />states we will accept 16% of that in July, 13% in August and it°lo in September <br />for your elevation. We would also accept that 4%, by weight, of the gravel that is <br />washed is retained water. If those are your only water uses and you are able to <br />make those calculations, then we could likely accept your engineering work for the <br />water supply report. <br />Although this should be verified with your water commissioner, I suspect that a <br />1986 water right is too junior to be in priority when you are using water. <br />Therefore, you will be required to operate under a court decreed plan for <br />augmentation or a substitute water supply plan and you would have to purchase <br />replacement water for the operation. <br />http: //www.water. state. co. us/pubs/DOlicies/pol icy2003-2. pdf <br />The type of substitute water supply plan you could use is identified in the link <br />below. You should be eligible for a CRS 37-92-308(5) plan, but you must provide <br />notice to all people on the SWSP notification list and pay the annual fee of $300. <br />Afso, you can only operate that plan for 5 years. <br />12/30/2005 <br />
