Sullivan, P.E.
Permitted Acres: 399
This form contains a chronology and other information to assist the Board in considering
the request for clarification of a stipulation/condition of a June 25, 2003 Board Order,
amended October 29, 2003. This is intended to supplement the packet mailed to the
Board, containing a copy of relevant correspondence, the subject Board Orders, and
Division Rationale.
Chronology of Events
- June 25, 2003, the Board approved Amendment No. 1 with two stipulations.
• Stipulation "2) Aggregate Industries shall sample Karen Topper's domestic water
supply well, permit no. 2455, for DIMP prior to and after de-watering begins, and
shall submit the results to the Division and to Ms. Topper within 30 days of the
sampling date."
reviewed the hearing tapes. The hearing tapes contained the following
pertinent quotes:
Mr. Steve 8rancucci, for objector Ms. Karen Topper: My name is Steve
Brancucci. I'm representing Karen Topper. And in listening to the presentation
so far that Mr. Oehler has, in my opinion, has addressed a lot of my sister's
concerns and the conditions that were placed on the mining permit approval and
so forth. I think one of her concerns was the drinking water at the house there for
my mother. Mr. Refer referred to, or his associate, at least doing one testing on
that's, those wells up there, and I think it would be beneficial, once they started
their dewatering process to a 15-foot level, whatever, that an additional water test
be done. Because once you start to activate the ground water moving out of the
lakes and through the aquifer down towards the river, it might activate the level of
any contaminants in the water supply. Other than that, I think the staff and
Aggregate Industries has addressed most of our concerns.
Mr. Harry Javernick, MLRB: I appreciate your comments because it confirms
what I had read from the June 3` letter that it looked like all the issues had been
