Simpson, P.E. <br />State Engineer <br />Your letter dated January 27, 2003, requesting renewal of the above referenced substitute water <br />supply plan to cover depletions caused by an existing gravel mining operation has been reviewed. The <br />required fee of $217 for the renewal of this substitute water supply plan has been submitted. The original plan <br />was approved on July 27, 1998 and it was most recently renewed on April 18, 2000. An augmentation plan for <br />the site was filed with the Division 1 W ater Court in Case No. 2000CW 142. <br />The anticipated net depletion for this plan is 43.88 acre-feet per year for a total of 22.89 acres of water <br />surface exposed after December 31, 1980. According to the information submitted, 82.47 acres of water <br />surface, out of a total of 128.85 to be exposed at the site, was exposed within the reclamation permit boundary <br />prior to January 1, 1981. You have provided a monthly breakdown of the depletions for this year of operations <br />from March of 2003 through February of 2004. The depletions total 23.88 acre-feet of net evaporative loss, <br />14.09 acre-feet of water used to batch concrete (which represents production of 153,120 cubic yards of <br />concrete), 0.48 acre-feet of water lost with mined product (which represents 16,488 tons of mined product), <br />and 5.40 acre-feet of water used for dust control. Phreatophyte credits of 5.29 acre-feet per year have been <br />applied to this plan. <br />The proposed sources of replacement water for this pit are 27.6 Barnes Ditch inches diverted from the <br />Big Thompson River and previously used for irrigation of the mined property and 93.62 units of Colorado-Big <br />Thompson Project water owned by Loveland Ready Mix. The Barnes Ditch inches, from dry-up of <br />approximately 42.2 acres of alfalfa and barley, provide a dry year total of 45.38 acre-feet of historic net stream <br />depletions during May through October, and carry an historic return Flow obligation of 1.48 acre-feet during <br />November through April. The acreage dried-up will need to be verified by the Division Engineer prior to any <br />renewal of this plan. Replacements during May through October will be made by diverting the Barnes Ditch <br />water, measuring it, and then returning it to the Big Thompson River. Adequate flow measuring devices, <br />satisfactory to the Water Commissioner, must be installed for the administration of this replacement water <br />from the Barnes Ditch. Replacement for depletions during November through April, plus shortages after <br />Barnes credits during July through October, will be met by releases of C-BT water owned by Loveland Ready <br />Mix. At a quota of 0.3 acre-feet per unit, the 93.62 units committed to this plan will provide up to 28.09 acre- <br />feet of replacement credit. The C-BT units are approved for use in this temporary substitute water supply <br />plan. However, they cannot be used as a replacement source in a permanent plan for augmentation for this <br />site. <br />I hereby approve the proposed substitute water supply plan in accordance with §37-80-120, C.R.S. <br />subject to the following conditions: <br />
