Approximately St <br />acres of Pond 6 will be reclaimed and approximately It acre will remain as a fresh water <br />Pond. <br />7. Approximately 20,000 c.y. of inert waste material from both onsite and offsite <br />will be placed in the remaining 2t acres of the waste concrete and inert fill area. A <br />maximum of 5,000 cy of inert fill and/or waste concrete will be stored on site prior to <br />backfilling at any one time. <br />8. Loveland Ready Mix will use the Division's recommended seed mix. <br />6.4.7 Exhibit G -Water Information <br />9. The average depth to groundwater for the remaining areas to be excavated is 6 f <br />feet. <br />10. Loveland Ready Mix will accept the Division's reclamation cost of $300,000 but <br />we plan to ask for a reduction in the financial security when the lining of cells 6 and ?has <br />been accepted by the S.E.O. <br />12. Because a significant percentage of the lining of Cells 6 & 7 has already been <br />completed, Loveland Ready Mix will bond for 100% of the liner installation in <br />accordance with the Divisions' 100 percent performance guazantee option for lining <br />Ponds.. <br />6.4.19 Exhibit S -Permanent Man-made Structures <br />13. Landmark Engineering is working with the City of Loveland to reach a structure <br />agreement covering the sewer line, the switchyazd, and the power lines. To date, we have <br />been unable to reach an agreement but are continuing our efforts. We will continue <br />trying to obtain a structures agreement from the City of Loveland, but at this time we <br />commit to staying twice (2x) the depth of excavation away from all City utilities and <br />streets. <br />14. Loveland Ready Mix Concrete, Inc. hereby commits to maintain a minimum <br />setback distance of at least twice (2x) the depth of excavation as measured from the toe of <br />excavation to the edge of any and all structures and to cleazly mark the setback distance <br />prior to any excavation. <br />15. No work associated with the Permit requires a Section 404 permit. Terry McKee <br />of the USACOE has previously been on site to assist us in confirming our compliance <br />
