The R.O.W. for County Road 19E (Namaqua Avenue), the City sewer line, and <br />the switchyard lie within 200 feet of our planned excavation. We agree to a minimum <br />setback of twice (2x) the depth of excavation as measured from the toe of excavation <br />from all these structures as further discussed in Section 6.4.19, Paragraph 14 of this letter. <br />Wilson Avenue is within 200 feet of prior excavations. The Ponds on the south side of <br />the river were mined prior to the construction of Wilson Avenue. The area abutting <br />Wilson Avenue north of the river has been reclaimed to an approximate 200-foot setback <br />from the road. The golf course was also constructed after the mining of the two Ponds on <br />the west end of the property and is approximately 200 feet from any. <br />
