• Bill Tyner, Assistant Division Engineer <br />C • Mike Graber, dam Safety Engineer <br />• Bruce Smith, Water Commissioner, Water district 11. <br />A letter was signed by Mr. Graber and Mr. Tyner that had the following conclusions: <br />• Mining activities as described should not require a Substitute Water Supply Plan <br />approved pursuant to Colorado Revised Statutes 37-90-137 (11)(a), but evaluation by the <br />State Engineer's Office will be conducted as provided for under the statute. <br />• Should conditions at the site change whereby there was exposure of ground water, <br />saturation of or due to a desire by the operator of the gravel mining operation to being <br />washing of material onsite or use of water from the site for dust control it would be <br />necessary to obtain a Substitute Water Supply Plan approved pursuant to the above <br />statute to continue any further mining operations. <br />• ..., there appears to be minimal risk of a water rights problem with this point of diversion <br />due to mining operations. <br />• .... the excavation is expected to be entirely below the natural ground surface and no <br />storing of water is anticipated, therefore there are no issues with construction of a dam or <br />related safety issues. <br />Item number 2 is recommended mitigation for the site but it is not within BLM's jurisdiction to <br />enforce it, therefore it will be noted and a copy of this environmental assessment will be <br />~ " provided only as a courtesy to the Colorado Division of Minerals and Geology for their <br />permitting process. <br />The proponent is planning to obtain a Colorado Division of Reclamation, Mining, and Safety <br />pemvt for the site locality. This will provide for additional analysis of mining, reclamation, and <br />safety provisions required by the state permit. <br />MTTIGATION MEASURES: <br />1. No initial disturbances of vegetation during the time period of May 15 to July 15, a <br />primary bird nesting time period. Once the initial vegetation is disturbed, subsequent <br />work can continue in these areas at any time of the year. <br />2. The applicant be responsible for the cost of control of any state or federally listed noxious <br />weed that become established on the site as a result of the disturbance caused by the <br />mining operation. <br />3. All fuel storage and refilling shall take place outside of water drainage areas. <br />4. Reclamation practices will be defined within the State DRMS permit. Bonding <br />requirements will be identified within this permit also. <br />5. Once the quarry phase is completed, reclamation work maybe required to create a <br />suitable soil layer for a seed bed and re-vegetation. Any artificial seeding should be done <br />with native vegetation adapted to the site. <br />6. Maintenance and continued use of the public land for a detention basin should be <br />authorized, probably by a Section 302 FLPMA lease.
