Walther <br />Executive Director <br />Michael 8, long <br />Division Director <br />Thank you for taking the time to be involved in the State of Colorado's process of <br />reviewing applications for new (or revisions to existing) mining operations. The <br />purpose of this memo is to explain the 112 Reclamation Permit application <br />process, your rights as either a party or a non-party, and the jurisdiction of the <br />Mined Land Board: The Office and Board operate under the provision of the <br />Construction Materials Act (Act), if the application is for the extraction of <br />construction materials. We operate under the Hardrock Act (Act), if the <br />application is for the extraction of non-construction materials. <br />If an application fora 112 Reclamation permit for a Construction Materials or <br />Hazdrock operation is approved by the Boazd or Office, the approved permit is for <br />the life of the mining operation (Life of Mine) since our permits have no expiration <br />date. The permit may be revoked and the reclamation bond forfeited to the State <br />only by an action of the Mined Land Reclamation Board. Revocation and <br />forfeiture may occur due to an uncorrected violation of-the Act, Rules and <br />Regulations, or the terms of the approved permit. <br />THE ROLE OF THE MINED LAND RECLAMATION BOARD (BOARD): <br />The Mined Land Reclamation Board (NLRB or Board) is aseven-member Board <br />that serves at the pleasure of the Governor. The Governor appoints five Board <br />members from nominations submitted by each of the various constituencies <br /> <br />
