Summary Document: listing the issues gleaned from all of the written comments on the <br />Mascot Placer CN-001 application and received by DMG during the public comment period. <br />Date: May 21, 2004 <br />Prepared by: Allen Sorenson, Division of Minerals and Geology rj <br />Action:Conversion application CN-001 to Convert Everist Materials, LLC Mascot Placer <br />Operation, Permit No. M-1998-052 from a section 110 limited impact permit to a section <br />112 regular permit. <br />Issues that Clearly fall under the Jurisdiction of the Colorado Mined <br />Land Reclamation Board: <br />1. Potential for adverse impacts to waters of the United States, including wetlands. <br />2. Potential for adverse impacts to wildlife. <br />3. Potential for contamination of surface and ground water. <br />4. Potential for offsite impacts caused by dust generated at the mining operation. <br />5. Adequacy of grading, plant growth materials, and revegetation plans. <br />Issues that may not be Considered under the Jurisdiction of the <br />Colorado Mined Land Reclamation Board: <br />Note: this list of issues has been prepared by the Division of Minerals and Geology as staff to the <br />Mined Land Reclamation Board. The final determination of jurisdiction rests with the Board. The <br />Division's position on whether the Board will consider an issue is based on the staff's knowledge of <br />the Colorado Mined Land Reclamation Act and other pertinent laws, the Mineral Rules and <br />Regulations of the Mined Land Reclamation Board, and past decisions of the Board. <br />I. Whether or not rock crushing should be allowed at the Mascot Placer. (Summit County <br />Planning Dept. has notified the Division of Minerals and Geology that a county special use <br />permit would be required for crushing operations). <br />2. The design and condition of Tiger Road. <br />3. Truck traffic issues relating to safety, dust, and noise. <br />4. Impacts that mining, processing, and hauling may have on the quality of life in the area. <br />5. Impacts that mining, processing, and hauling may have on property values in the area. <br />6. Whether or not the operation is compatible with residential and recreational uses in the area. <br />7. Whether or not the operation is compatible with county master plans. <br />8.
