The decision date for your application is scheduled for February 24, 2003. <br />Therefore, I would appreciate a response from you on or before February 14, 2003..(Please be <br />sure to include two (2) copies of your response). Please be advised that your conversion <br />application may be deemed inadequate and may be denied on February 24, 2003 unless the <br />following adequacy review items aze addressed to the satisfaction of the Division. <br />6.4.4 EXHIBIT D -Mining Plan <br />1. The Mining Plan Map -Sheet 4 of 4 (Floodway/Floodplain Delineation) shows 3100 linear <br />feet of flood control berm along the southern and western permit boundazies. The berm will be <br />at least 1$-24" in height and will have a minimum top width of 10'. The Existing Conditions <br />Map does not show such a flood control berm. The Reclamation Plan Map, Exhibit F also does <br />not show this berm. The Division requests that you clazify the timing of installation of this berm, <br />the volume of materials needed and cost for construction of this berm, and timing for removal of <br />the berm. Please respond. <br />2. The applicant specifies that small water impoundments maybe used for wetlands construction. <br />The applicant has also provided a wetlands delineation report which verifies the presence of <br />approximately 0.72 acres. Review of the Mine Plan Maps indicates that some existing wetland <br />areas will be eliminated during future mining. The Reclamation Plan Map, Exhibit F shows at <br />least four (4) flat wetland aeeas. Please clarify how these wetland areas will be established, and <br />
