COOLEY RESERVOII2 AND FULTON WII.DLIFE AREA PIT AMENDMENT NO. 1- JERONIMUS PROPERTY (Revised 05/03) EXHIBIT S -PERMANENT MAN-MADE STRUCTURES (Continued) South Adams Water and Sanitation District Sewer Line The District has a sewer line along the affected land's east boundary north of the Xce[ Energy right-of--way, and across a small portion of the southeast corner of the property. An additional Slope Stability Analysis approved by the DMG shall determine the mining setback from this sewer line. AI will also execute an Agreement acceptable to the DMG with the South Adams Water and Sanitation District, and no mining shall be allowed within 200' of the District's sewer line until the DMG has determined this Agreement is acceptable. Topper Property Structures The Topper property is located north of the Xcel Energy right-of--way along the east boundary of the affected land. This property has miscellaneous structures, such as fencing, a home, well, etc. The South Adams Water and Sanitation District's sewer line is located 15' + west of this fence, and the additional Stability Analysis shall determine the setback of less than 200' from this property's boundary and the sewer line. However, no mining within 200' of the fence line shall be allowed unless AI enters into an Agreement with this property owner acceptable to the DMG, prior to any mining closer than 200' being undertaken, United Power Power Poles Along East Side of Fulton Ditch A series of power poles in located along the east side of the Fulton Ditch from 104`" Avenue. Power service on these poles is not probably required, and AI may request that United Power remove these pole. However, as long as these poles are located on the property, no reining shall be allowed closer than 35' to these power poles shall be allowed, unless an Agreement acceptable to United Power and AI for a closer setback is executed. The suitability of this 35' setback was determined in the original Slope Stability Evaluation which is included as the GEOTECHNICAL STABII.ITY EXI~IT for this AMENDMENT NO. 1 application. Miscellaneous Structures Along East Property Line, South of Xcel Right-of--Way There are miscellaneous structures along the affected land's east boundary south of the Xcel Energy right-of--way and along the south boundary of the affected land. An additional Slope Stability Analysis approved by the DMG shall determine the mining setback from these structures. Until this Slope Stability Analysis is approved by the DMG, no mining shall be allowed within 200' of the property's east boundary south of the Xce] Energy right-of--way.
