COOLEY RESERVOII2 AND FULTON WII.DLIFE AREA PIT AMENDMENT NO. 1 - JERONIlVIUS PROPERTY (Revised 05/03) EXHIBIT S -PERMANENT MAN-MADE STRUCTURES The purpose of this Exhibit is to specifically identify permanent man-made structures either off-site or on-site within the permit area that are within 200' of any proposed mining. The following man- made structures are: Xcel Energy -Transmission Towers A major transmission power line crosses on property owned by Xcel Energy between the two parts of the property, and there are two transmission towers on the Xcel Energy property within 200' of the affected land. No mining is proposed within 200' of either of these two towers. Fulton Irrigating Ditch Company -Fulton Ditch The Fulton Ditch abuts the affected land's west boundary. Per the standards in the existing permit, no mining shall be allowed within 65' from the inside top of the high bank of the Ditch without an Agreement acceptable to the DMG between the Ditch Company and AI. The suitability of this 66' setback was determined in the original permit for mining setback on the other side of the Fulton Ditch, and a copy of the original Slope Stability Evaluation is being resubmitted as the GEOTECHMCAL STABILITY EXHIBIT for this AMENDMENT NO. 1 application. AI will need to execute an Agreement acceptable to the DMG with the Ditch Company to cross the Fulton Ditch with conveyor and piping structure(s) prior to installation of the support structures. In addition, in the event an Agreement is executed allowing mining closer than 65' to the Ditch, copy of this Agreement shall also be submitted to the DMG for approval, and to the County, prior to any mining being undertaken within 6S of the Fulton Ditch. 104th Avenue (SH#44-CDOT) and Miscellaneous Utilities Under and Above Roads -United Power, Qwest, Xcel Energy, and South Adams Water and District. The above road abuts the affected land on the north. Within the right-of--way of 104th Avenue, are above ground and below ground utilities owned by United Power, Qwest, Xcel, and the South Adams Water and Sanitation District. However, no mining proposed within 200' of the 104`h Avenue right-of--way.
