Banks and Gesso, LLC <br />INTRODUC71ON <br />On behalf of our client, All-Rite Paving and Ready Mix, Inc., this document presents an <br />Application for Amendment to Division of Minerals and Geology, Colorado Mined Land <br />Reclamation Board (CMLRB) Construction Materials Regu{ar 112 Permit No.M-1999- <br />005 for the Applicant's North River Pit. <br />The Applicant is applying for this permit to allow for mining additional sand and gravel <br />from a 35-acre acre in the southeastern portion of the permit area. This additional <br />mining area was originally proposed to be the Phase One mine area during the initial <br />permitting process for the property in 1999. Prior to approval of the original permit, the <br />area was withdrawn from mining due to concerns about the potential existence of <br />wetlands on that portion of the property, however it remains within the Permit Boundary. <br />Since the time of original application, the Applicant has had a wetlands delineation report <br />performed by Wright Water Engineers which indicates that no wetlands exist on this part <br />of the property. This report is attached as Appendix A for your reference. The 35-acre <br />area to be added to the mining plan can be found on Exhibit C -Mine Plan Map. <br />As with the other mining areas of the original permit, the new mining area will be <br />reclaimed as an unlined body of water with limited wildlife habitat. Technical aspects <br />regarding the specifics of how reclamation will occur will remain unchanged.
