It was in a subsequent Technical Revision that the parcels were shown as <br />separated by a 100 foot wide strip of land. There was never any intent to exclude this <br />strip from the permit and thereby to cut off access to the north nor any plan to put <br />another plant on the southern parcel and take access to public roads from this parcel. <br />I personally prepared the M91-035 Amendment and subsequent Amendment and <br />Technical Revision and I cannot explain how this strip was omitted other than by an <br />inadvertent drafting error. Included in this TR are affidavits from myself, as lead <br />consultant on all permits and amendments, Martin Jones, former Vice President and <br />General Manager of Western Aggregates, Inc. (a predecessor to Mineral Reserves, <br />inc.) and Harold Spicer, owner of the mineral rights (subsequently transferred to Spicer <br />Minerals Corp.)
