The TR responds to <br />your June 28, 2002 Inspection Report on the Bluestone Sand and Gravel Mine. <br />The TR contains the following: <br />- a material balance report <br />- revised mine plan and reclamation plan (including revised post-mining contours) <br />- affidavits from Harold Spicer, Martin Jones and Paul Banks with respect to the <br />100 foot wide strip of land along the southern boundary of the Spicer lease area <br />that was inadvertently omitted from the previous mine plan Exhibit C <br />- revised lease agreement with Spicer Minerals Corp. concerning the inadvertently <br />omitted land <br />The initial permit showed a reclamation plan that included 30 feet deep mine pits. <br />Currently, some of those pits have been filled with washed fines from processing. The <br />reasons for this discrepancy are twofold; 1) some of the earlier mining activities had <br />some production inefficiencies resulting in more material deposited in the fines ponds <br />than was anticipated, and 2) the total depth of mining has not been as deep as originally <br />planned (due to the need to avoid ground water in order to effectively process the <br />aggregate). As a result of all these factors the existing post-mining contours on certain <br />areas do not conform to the previously planned contours, hence the need for this TR. <br />The operator does have the legal right to mine the 100 foot strip between Sections 4 <br />and 9 (between the Spicer and McKay parcels). The original DMG application to <br />combine these two parcels into one permit (i.e. M91-035) clearly shows the two areas <br />
