Please see the revised Exhibit L. The costs have been updated to show that there will be <br />soil replacement on 100 acres and revege[a[ion on 148 acres. <br />6.4.13 EXHIBIT M -Other Permits and Licenses <br />33. Enclosed is a copy of the approval letter from the USACOE and the associated approval <br />letter from the USFWS. On [op of that package is the approval of a request for an <br />extension of time to complete the low-water crossing until Mazch 2007. The SWSP for <br />the entire permit, including the amendment area, has been approved by the State's <br />consultant and is awaiting final approval by the SEO. Final approval of the plan and well <br />permit is expected later this month. As is common with these SWSP's, this procedure <br />has taken some time with the SEO. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />34. The Mine and Reclamation Plan Maps have been revised to show that [he limit of mining <br />will be 200 ft away from State Hwy. 52 in the south part of the permit area and therefore, <br />no structure agreement with CDOT is required at this time. We will either submit a <br />geotechnical study showing no impacts to State Hwy 52 (and other utilities) due to <br />mining closer than 200 ft or develop a structure agreement that will be approved by <br />CDOT (and other utilities). <br />35. The only agreements that have been approved and signed-off on by structure owners <br />within 200 ft. of our mining has been ENCANA Energy and United Power. Copies of <br />those agreements are enclosed. A]] mining so faz has been confined to Cel] 1 and we <br />have stayed 200 ft away from the existing oil wells and tank batteries. It made more <br />sense to get agreements with all the oil companies at once and to include the amendment <br />area. These agreements will be completed in the next two months and will be forwarded <br />to the DMG for the permit file. Until that time, all mining activities will remain at least <br />200 ft. away from any man-made structures for which no agreement has been approved, <br />Comments from Other A¢encies <br />36. Please see enclosed letter from Peter Davis, PhD, dated June 13, 2006, addressing the <br />CDOW comments. <br />This concludes our responses to the adequacy review for the Turnpike Mining Resource <br />Amendment-1.
