4) The Mine Plan Map Cb Existing Disturbance Map shows the conditions as they <br />currently exist. Forest Service Road 228 crosses Taylor Gulch at the present time and <br />until the road re-alignment north of the crossing is completed. Road construction was not <br />considered an approved action at the site last fall and until FS Road 228 above the mine <br />can be accessed via through the mining azea, the crossing at Taylor Gulch will remain. <br />The rip-rapped, bermed area leading to the existing crossing will be built up after the road <br />construction above so that vehiculaz traffic cannot drive across the road at the original <br />location. <br />5) Correspondence with Colorado Lime is on-going and we may have something in <br />writing soon. However, at the present, I am forwazding my latest copy of request for <br />response to the .25 acre of reclaimed land. US Lime Company verbal <br />conespondence(T.Gun, 2/23/07) requested that the .25 acre of reclaimed land be <br />specifically included with bond coverage sufficient to monitor and maintain the <br />reclaimed lands until determined to be fully reclaimed. A written agreement to this <br />condition will be drawn up and signed by both parties. <br />6) There is no written data regarding a historic mine operation directly above the current <br />location in the mine that appears to show former vertical shaft development now <br />backfilled with fractured marble rock. It is likely that there will be no shaft to fill or <br />close. In the event that any former underground mining operations aze exposed or <br />disturbed, Colorado Marble will commit to developing and implementing an approved <br />closure procedure for each specific site. <br />7)Due to the fact that this mine will operate June through September each yeaz, no <br />permanent structures will be left at the site season to season. No permanent structures <br />such as footers, foundations, or concrete slabs aze planned for the site. Contract mobile <br />equipment will be transported to and from the site each season, including all tanks, <br />trailers, bins, etc. <br />8)The operator respectfully disagrees with the Division's position concerning the removal <br />of the berm and lowest sediment pond after mining is completed and the site has been <br />successfully reclaimed. The berm and sediment pond needs to stay in place for at least <br />ten yeazs after reclamation has been initiated. This may well be 40 yeazs from present. <br />If the sediment pond continues to need maintenance, that fact alone should preclude its <br />removal. The berm soils and sediment structure will be planted with native grasses, <br />fortis, and shrubs that afford wildlife support to a greater degree than re-disturbance to <br />remove the berm. Nevertheless, Colorado Mazble will commit to the reclamation of <br />berm and sediment pond after mining and reclamation has been completed. <br />The Reclamation Map will show the structures removed. <br />
