Road Runners Rest II - M-79-195, Technical Revision RECEIVED FEB 1 2 200a Division ~f Minerals and Geology Suburban Sand and Gravel is submitting this Technical Revision to address a change in final reclamation for the Road Runners Rest iI mining permit for an area along the northern part of the permit area where the Colorado Department of Transportation ("CDOT") is planning to construct an extension of 120th Ave. As a threshold matter, please note that Suburban continues to assert that it cannot and should not be responsible for obtaining approval for activities conducted by other parties on land that Suburban does not own, and over which Suburban has no control. Nevertheless, the Mined Land Reclamation Board ("NLRB") has taken the position that Suburban is subject to enforcement action and penalty if it does not obtain approval of a change in the Road Runners Rest II final reclamation plan for such activities. Accordingly, this Technical Revision showing the construction and fill activities intended by CDOT is submitted. Any questions about those activities or requests for changes in the final reclamation plan should be directed to Rene Valdez, Project Manager for CDOT for the 120th Ave. project, as Suburban has no control over CDOT's activities. The 120th Ave. extension will traverse the northeast corner of the Road Runners Rest II permit area, as shown on the attached Exhibit 1. Most of the affected area falls outside the mining disturbance and no reclamation is currently required. In the portion of the project area that overlaps the South Platte River, the construction of 120th Ave. will require filling and grading the slope down to the River. We understand details of this portion of the construction are covered under an agreement among CDOT and Denver Water and South Adams County Water and Sanitation District "SACWSD"). Denver Water and SACWSD own the property associated with the Road Runners Rest ii mining permit. TECHNICAL REVISION #1 A change is requested in the reclamation plan for the area within the Road Runners Rest II permit boundary which is outlined in yellow on the attached Ezhibit 1 from wildlife/private recreation to roadway
