Nevertheless, the Mined Land Reclamation <br />Board ("NLRB") has taken the position that Suburban is subject to <br />enforcement action and penalty if it does not obtain approval of a <br />change in the Road Runners Rest II final reclamation plan for such <br />activities. Accordingly, this Technical Revision showing the <br />construction and fill activities intended by CDOT is submitted. Any <br />questions about those activities or requests for changes in the final <br />reclamation plan should be directed to Rene Valdez, Project Manager <br />for CDOT for the 120th Ave. project, as Suburban has no control over <br />CDOT's activities. <br />The 120th Ave. extension will traverse the northeast corner of the <br />Road Runners Rest II permit area, as shown on the attached Exhibit 1. <br />Most of the affected area falls outside the mining disturbance and no <br />reclamation is currently required. In the portion of the project area <br />that overlaps the South Platte River, the construction of 120th Ave. <br />will require filling and grading the slope down to the River. We <br />understand details of this portion of the construction are covered <br />under an agreement among CDOT and Denver Water and South Adams County <br />Water and Sanitation District "SACWSD"). Denver Water and SACWSD own <br />the property associated with the Road Runners Rest ii mining permit. <br />TECHNICAL REVISION #1 <br />A change is requested in the reclamation plan for the area within the <br />Road Runners Rest II permit boundary which is outlined in yellow on <br />the attached Ezhibit 1 from wildlife/private recreation to roadway <br />
