Page Two <br />December 14, 2004 <br />The above commitments and conditions of approval were agreed to by DMG and VCI in <br />order to protect all property owners along this reach (north bank and south bank) of the <br />Cache la Poudre River. The commitments and conditions of approval also provide for <br />review of the CFCP by the entities and agencies (i.e.: Weld County, Colorado Water <br />Conservation Board, and Federal Emergency Management Agency (FEMA) responsible <br />for floodplain management along this reach of the Cache la Poudre River. <br />Interim Flood Control Measure <br />As you are aware Anderson Consulting Engineers, Inc. (ACE) has completed an initial <br />hydraulic analysis (ACE, October 4, 2004) that indicates the potential for floodwaters <br />associated with the 100-year event to reach structures owned by Bliss Produce Company. <br />This conclusion was reached by comparing predicted existing condition water surface <br />elevations with design floor elevations for the structures as shown on the available Flood <br />Hazard Development Permits filed with Weld County. During a meeting at the Durham <br />Pit on November 30, 2005, Bliss Produce Company agreed to allow VCI to obtain as- <br />built floor elevations on the potentially impacted building. The survey information will <br />be utilized to confirm the need for protection and if required the vertical extent of <br />protection. If protection is required; in conjunction with Bliss Produce Company, <br />alternative interim flood control measures will be developed for consideration. <br />Following a review of the feasible alternatives, one will be selected for implementation. <br />Comprehensive Flood Control Plan <br />As indicated in the "Findings" the CFCP will address the following items: <br />1. Provide assurance that any potential adverse offsite impacts are minimized; <br />2. Satisfy-all applicable local, state, and federal floodplain rules and regulations; <br />3. Provide an itemized summary of construction costs; <br />4. Provide engineering plans and specifications for the plans; and <br />5. Provide a time schedule for completion of the CFCP. <br />The CFCP will be submitted to the review agencies in the format of a Conditional Letter <br />of Map Revision (CLOMR) as required by Weld County and FEMA. The CLOMR will <br />summarize the hydraulic analyses performed in support of the CFCP.
