1.1r. Ed Gaunt
- 3 -
IJOVember Z1 , 1989
To summarize our evaluation and conclusions would be appropriate here. The
Division feels that TBM could make application to the Mined Land Reclamation
Board fora change in designated post-mining land use from rangeland/wildlife
habitat to residential development fora portion of the permit area. If the
Board were to agree to such a change, TBM could seek bond release for such
areas, and the liability period would be reduced substantially. These areas
could then be excised from the permit area and TBM would have no further
responsibility for them. In order for TBM to demonstrate that the change was
prudent, TBM would need to address, at a minimum, the items raised under
Consideration of Alternative Land Use contained in the attached memorandum,
an a requiremen s o u e With these requirements satisfactorily
addressed, the Division would be willing to schedule a Board hearing for
consideration of the request.
I hope I have adequately addressed your letter and our past concerns in this
correspondence. If I can be of further assistance please contact me.
Sincerely
Michael S.
