The <br />Division feels that TBM could make application to the Mined Land Reclamation <br />Board fora change in designated post-mining land use from rangeland/wildlife <br />habitat to residential development fora portion of the permit area. If the <br />Board were to agree to such a change, TBM could seek bond release for such <br />areas, and the liability period would be reduced substantially. These areas <br />could then be excised from the permit area and TBM would have no further <br />responsibility for them. In order for TBM to demonstrate that the change was <br />prudent, TBM would need to address, at a minimum, the items raised under <br />Consideration of Alternative Land Use contained in the attached memorandum, <br />an a requiremen s o u e With these requirements satisfactorily <br />addressed, the Division would be willing to schedule a Board hearing for <br />consideration of the request. <br />I hope I have adequately addressed your letter and our past concerns in this <br />correspondence.
