BANTA, Director <br />November 21, 1989 <br />Mr. Ed Gaunt <br />Trinidad Basin Mining Company <br />HC 81, Box 6 <br />Barbourville, Kentucky 40906 <br />RE: Request for Bond Release for Trinidad Basin Mine (C-81-048) and <br />Alternative Land Uses at the Mine. <br />Dear Mr. Gaunt: <br />I am in receipt of your November 13, 1989 letter requesting bond release. <br />I would like to address your request and the related issue of development <br />(ranchette subdivision) at the TBM mine site. <br />Bond Release <br />For coal mining operations in Colorado, bond release after reclamation is a <br />three phased process. The first phase release (encompassing up to 60% of the <br />original bond amount) occurs after the operator has successfully completed <br />backfilling, regrading, and drainage control. TBM completed this phase and <br />received ;198,420 of the original bond bade in 1986. Of the remaining bond <br />($132,280), up to 85b of the original bond amount (up to 582,675) can be <br />released when TBM demonstrates to the Division that the site has been <br />successfully revegetated and that the site is not contributing suspended <br />solids to streamflow or runoff outside the permit area in excess of pre-mining <br />levels or on adjacent non-mined areas. The remainder of the original bond <br />amount may not be released until completion of all mine related reclamation, <br />and not prior to the expiration of a ten year liability period which initiates <br />after the last year of augmented seeding. <br />At this time, TBM could be eligible for return of up to 85% of the original <br />bond amount if all criteria are met. For consideration, TBM needs to submit a <br />bond release application and request, and the following procedures need to be <br />initiated. First, TBM must send written notice of their intent to request <br />bond release to the following parties: all adjoining property owners, all <br />surface owners within the permit area, appropriate local government bodies, <br />municipalities, regional planning commissions, boards of county commissioners, <br />county planning agencies, sewage and water treatment authorities, and water <br />conservancy and water conservation districts in the vicinity of the mine. <br />These letters should be sent certified mail. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
