Mail, within one (I) day afrer receipt of this Notice, to the Mined Land Reclamation Boazd, <br />written notice of your compliance with pazagraph one (1) of this Cease and Desiea Order. <br />Complete the following corrective action: <br />Include all affected lands into the permit through a permit amendment by <br />September 18, 1995 unless objections aze received. If objections aze rea:ived, then the <br />permit amendment must be completed by October 18, 1995. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of $4,500.00, <br />within 30 days of the signature date of this document. This is based upon an assessment of <br />$100.00 per day for 45 days of violation, from April 28, 1995 to June 12, 1995, With $3,500.00 <br />suspended upon completion of the corrective action outlined in this order. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties aze <br />advised to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed within a <br />certain time, shall be construed as a permit.or license to engage in any prospecting or mining operations <br />within the State. <br />Persons concerned with judicial review of the provisions of this Order aze advised to consult <br />C.R.S. 24-4-106, as amended. <br />ti <br />Dated at Denver this ~~ day of -~^~ ~ S <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
