• • STATE OF COLORADO MINED LAND RECLAMATION BOARD DEPARTMENT OF NATURAL IN THE MATTER OF: Varna Companies, Inc. )NOTICE OF VIOLATION M-95-048 2130 S. 96th S[ree[ ) AND Broomfield, CO 80020 ) CEASE AND DESIS7' ORDER TO: Varna Companies and all other persons engaged in or owning or controlling the following operation: Jenkins Pit, Section 27, T1S, R70W, 6th P.M., Boulder County. FINDINGS OF FACT Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by C.R.S. 34-32-124, the Boazd hereby makes the following fmdings of fact: 1. Varna Companies, Inc. is permitted to conduct a mining operation under the ternvs of Permit M-77-393 located in Section 27, Township 1 South, Range 70 West of the 6th P.M., in Boulder County, Colorado. 2. The Mined Land Reclamation Boazd conducted a Formal Public Hearing on June 22, 1995 to consider possible violation of the terms of Permit M-77-393 and C.R.S. 34-32-101 et seg_ 3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on June 22, 1945, demonstrating that: Mining related disturbance had occurred on approximately 14.7 acres to the south of the permit azea perimeter. NOTICE OF VIOLATION Based upon these same Findings of Fact and in accordance with C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Boazd hereby finds Varna Companies, Inc. to be in violation of Permit M-77-393, specifically Exhibits C and D, and C.R.S. 34-32-116(7}(h). CEASE AND DESIST ORDER Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 34-32-124(2),(ti) and (7) the Colorado Mined Land Reclamation Boazd hert:by orders Varna Companies, Inc. to: 1. Cease and desist from conducting the following mining operations at the Jenkins Pit Permit M-77-393: Cease all mining related activities in unpermitted azea. Reclanation may continue.
