ACCESS PERMIT TERMS & CONDITIONS <br />1. This permit is issued to permit and allow the reconstruction of an existing access [o State Highway 285B <br />located a[ approximate milepost 147.100 right. <br />2. The access shall jointly serve that indicated on Page one; a maximum of one sand and gravel pit with a 3,000 <br />squaze foot equipment repair shop and a maximum of 3 single family dwellings on Parcel 099, <br />approximately 61.29 acres. <br />3. Should ANY future activities propose a change in the pemtitted use of this access (ie., subdivisions, <br />commercial, or residential developments, etcJ submittal of a new access application to the Department will be <br />required, which may result in the relocation or removal of this access, in conformance with the State Highway <br />Access Code Volume 2, Cade of Colorado Regulations 601-1. <br />4. Anew access application shall be submitted and a new access permit shall be issued by CDOT prior to any <br />increase in the herein permitted vehiculaz volumes, changes in the type of business permitted, or any auxiliary <br />lane construction activities. Under no circumstances will the access be allowed to operate in an unsafe <br />manner. <br />5. If [he Permit[ce is unable to commence reconstruction within one yeaz of [he date of issuance, [his permit will <br />become null and void unless an extension is requested in writing to the Department prior to the date of <br />expiration. Please refer to the enclosed Form 101, Page 2 for further requirements under'Tetmit Expiration". <br />The Permittee may request cone-yeaz extension from the issuing authority. No more than two one-year <br />extensions may be granted under any circumstances. <br />6. You must contact Chuck Hackett at the Department Shop on 10345 CR 120, Poncho Springs, Colorado or <br />telephony (719) 539-5417 [o mcet with him a minimum of two working days prior to beginning ~ access <br />improvements or construction of any kind within the highway right-of-way. This includes but is not limited to <br />the installation of side drain culverts and fencing. Failure to comply with this condition may result in <br />revocation of this permit. <br />7. A construction traffic control plan has been enclosed as part of this permit (EXHIBIT C). The Pennittee is <br />required to follow the Traffic Contra] Plan at all limes during access reconstruction work within [he State <br />Highway right of way. If the Petmittce has any traffic control questions please contact [he Region 5 Traffic <br />Engineer (3803 North Main Avenue, Suite 100, Durango, Colorado 81301, or telephone (970) 385-8360). All <br />traffic control shall be in conformance with the Manual on Uniform Traffic Control Devices, and all other <br />applicable standazds. No lane closures or traffic detours of any nature will be allowed unless pre-approved by <br />the Department <br />8. A FULLY EXECUTED COMPLETE COPY OF THIS PERMIT AND THE VALIDATED NOTICE TO <br />PROCEED MUST BE ON THE JOB SITE WITH THE CONTRACTOR AT ALL TIMES DURING ANY <br />RE-CONSTRUCTION OF THIS ACCESS. FAILURE TO COMPLY WITH THIS OR ANY OTHER <br />CONSTRUCTION REQUIREMENT MAY RESULT IN THE IMMEDIATE SUSPENSION OF WORK <br />BY ORDER OF THE DEPARTMENT OF TRANSPORTATION. <br />9. The access shall be reconstructed to thirty-five feet wide with a fifty foot radii, in conformance with M&S <br />Standard 203-1, copy enclosed. <br />10. The access shall be reconstructed perpendicular to the travel lanes of State Highway 285 for a minimum <br />distance of 40 feet or [o the right-of-way, whichever is furthermost, and shall slope down and away from the <br />adjacent pavement edge at a rate of 2r7o for a minimum of 20 feet. <br />11. The access approach shall be surfaced to the Right-of-Way Line with four inches of Hot Bituminous <br />Pavement (HBP Grading S or SX), four inches of Base Course (ABC Class 6) and ABC Class 1 Sub- <br />Base (Depth to be determined by the Senior Highway Foreman. Required depths indicate compacted <br />material. <br />
