JESSE LEE PIT <br />Expansion Application <br />(110 Permit to 112 Permit Conversion) <br />August, 2006 <br />Application Report <br />Page 2 of 3 <br />All operations of the pit will be in compliance with Chapter 9.1 of the Chaffee County Land Use <br />Code with the following Exceptions that aze requested under section 9.1.6.16: <br />9.1.6.3 Subsurface Water Restrictions <br />The existing pit floor is within 20 vertical feet of ground water. Therefore, an exception is <br />requested. All flows will be contained by diversion ditches going to settlement ponds so that all <br />water will reenter the ground prior to entering the Arkansas River or Maxwell Creek. <br />As the groundwater cannot be below the level of the river, and current groundwater level can be <br />monitored at the existing sediment ponds, a waiver to the monitor well requirement is further <br />requested. <br />9.1.6.5 Excavation Restrictions <br />There is existing excavation to form the approximately 3H:1 V slope within 50' of the northerly <br />properly line. No further mining will be done on this slope. This will be part of the Phase II <br />reclamation. <br />The expansion of the pit will come within 50' feet of Maxwell Creek. All pit water will be <br />diverted into the settlement ponds to prevent water pollution. There will be no impact to <br />neighboring properties because the surface ownership extends across Maxwell Creek. <br />9.1.6.12 & 9.6.1.20 Fencing Requirements <br />A 4' wildlife friendly fence is proposed to surround the pit in lieu of the standazd requirement. <br />This operation lies within private land with no direct public access, and no hazardous slopes will <br />be created during excavation. Wildlife friendly fencing will not compromise operational safety, <br />and the 4' fencing will be less visible from US Highway 285 or the Arkansas River. <br />The 10 yeaz plan to complete reclamation of the existing Jesse Lee Pit will address the goals of <br />the Chaffee County Comprehensive Plaa in the following ways: <br />Land Use -This operation proposes to reclaim this land to rangeland. <br />Community Chazacter -All aspects of this operation will occur in the pit floor and will not be <br />visible from either Highway 285 or the Arkansas River. By granting an exception to the fencing <br />regulation, the view from both of these ways will remain discrete. <br />Open Space/Agricultural Land -This landowner currently grants a fishing access easement to the <br />Arkansas River on the south side of Maxwell Creek (south of this operation). A potential for <br />recreational use of this land exists after reclamation to rangeland. <br /> <br />
