Albert Frei and Sons, Inc. <br />Frei Pit #3 (aka Bromley Pit) - M-f 979-165 <br />Technical Revision # 3 <br />As currently approved the final planned reclaimed use is <br />unclear. Some reference was made to commercial/industrial uses <br />with some revegetation depending on how fast filling were com- <br />pleted. The 1974 Adams County approved a Planned Unit Develop- <br />ment that was consistent with the Mined Land Reclamation Board <br />permit. It stated that industrial/commercial uses were planned <br />and once the final site layout was know an amendment would be <br />filed. In 1997 and 2005, Albert Frei and Sons, Inc. Filed an <br />amendments that spelled out the final used expected on the site. <br />A copy of the 2005 approval and PUD documents are attached. <br />As currently approved in Adams County the PUD is for filling <br />the entire property with inert material and then developing it <br />for industrial/commercial uses; including raw material storage <br />and sales, concrete and asphalt batching, and an office complex. <br />Copies of the most recent county permit and supporting maps are <br />attached for your review. <br />The site is in compliance with the County approval. We have <br />material storage located on the central part of the property, an <br />asphalt plant on the southern end and a concrete plant in the <br />northeast part of the site. <br />RECLAMATION PLAN CNANGES: <br />To correct the uncertainty in the original permit, the <br />planned reclaimed use is stated to be INDUSTRIAL/COMMERCIAL. Th1S <br />makes it consistent with the County Zoning. The original recla- <br />mation plan implies that the area would have been left nearly <br />level, it would have been graded and if not developed immediately <br />the area would have been revegetated. We believe this <br />revegetation, as used in the original plan, was to protect the <br />site between the completion of backfilling and the start of <br />development. This revegetation is not needed now since develop- <br />ment is nearly complete. We are removing the revegetation <br />element from the approved reclamation plan since development has <br />already taken place. <br />Since mining and backfilling is complete on the site, <br />reclamation is essentially done. Minor grading is being com- <br />pleted on the area west of the railroad tracks and then the <br />reclamation will be complete. The site is currently being <br />developed as noted above and we concur with your note in the <br />inspection report, that full revegetation is not appropriate for <br />this site since its long term use will be as a commer- <br />cial/industrial/stockpiling area. The revised Map Exhibit F - <br />Reclamation Plan Map shows the post mining topography of the <br />site. <br />
