I concur that this <br />amendment is the 8*h overall. I have reviewed the documents submitted <br />by the various referral agencies and appreciate their input. <br />The applicant ha's,been working closely with Clear Creek County to <br />make sure the relevant parts of the Mining and Reclamation Plans are <br />consistent between the County Land Use Permit and this amendment. We <br />will continue to do that as mining progresses. Albert Frei and Sons,- <br />, Inc. (A.F.S.), understand the. requirements of the US Army Corps of <br />Engineers. We have reviewed the Office of the State Engineers' letter <br />and understand all of-their.conditions of approval. We also understand <br />their comment concerning capture of stormwater. The approval for <br />storage in Lake Albert contains language to this effect and Frei has a <br />current NPDES permit for the mine to .cover any stormwater discharge. <br />Albert Frei and Sons, Inc:, will continue to work with the DOW on <br />wildlife issues around the mine. A.F.S. understands their concerns, <br />however, we disagree with the assessment that wildlife will suffer from <br />this expansion. IT is :our experience that there are more wildlife in <br />and round-the mine now then when mining began. The bighorn sheep herd <br />around the mine has grown"from a couple of animals in 1983 when mining <br />started to nearly 75 at this time. DOW has presented no hard evidence <br />to support their claim of increased mortality due to heavy truck <br />traffic, or that an increase of sediment in a water body will occur <br />from this site. Albert Frei and Sons; Inc., have to comply with all <br />clean water laws and the permits currently in place assure the Division <br />that they are in compliance.- Frei is doing everything necessary to <br />prevent sedimentation. from Clear Creek by the use of stormwater control <br />BMF's at the mine. When the proposed reclamation plan or the new area <br />was prepared; wildlife uses of the area were considered. Yes, there <br />will be some steep slopes. Many exist now in the area.
