IV. ENFORCEMENT ACTIONS ~e following identifies enforcement actions taken during this inspection, the required abatement and date of abatement for the Iolation, previous violations still requiring abatement and the termination of violations cited during previous inspections. Notice of Violation number NOV CV-2006-006 was issued from the Division office on September 18, 2006. Required abatements and dates of abatement are: Step 1: By 13 September 2006, cease dischazge of thickener underllow to Sedimentation Pond E. Step 2: By 13 September 2006, repair the thickener underflow pipe. Step 3: By 13 September 2006, perform immediate damage control activities on Foidel Creek. Step 4: By 13 September 2006, notify CDPHE, CDOW and the CE of this event. Step 5: By 29 September 2006, notify downstream water users (demonstrate to the Division). Step 6: By 29 September 2006, assess the dischazge and receiving stream water quality and toxicity impacts. Step 7: By 29 September 2006, submit coordinated plans for abatement. Step 8: By 30 October 2006, comply with CDPHE dischazge permit and direction, WQCC standards. Step 9: By 30 October 2006, re-establish all DRMS-approved sediment control systems. Step 10: By 11 December 2006, submit as-built (as-repaired) Pond E drawings. Step 11: By 11 December 2006, report, in writing, completion of Foidel Creek cleanup The dates of abatement for the following violation steps of CV-2006-006 are: ~ep 1: 13 September 2006, by site inspection Step 2: 13 September 2006, by site inspection.
