Long <br />Division Director <br />This memo is to clarify the "Enforcement" page of the inspection <br />report dated February 4, 1994 for the Twin Pines mine site and NOV <br />C-93-104 termination. <br />Observation and Facts: <br />Upon inspection, all grading of the bench and drainage structures <br />on the refuse pile reclamation was found to be complete. The <br />remaining step in the final reclamation of the refuse pile included <br />the placing of the geotextile fabric on the upper bench and a <br />portion of the ditches. Due to the need to use the bench by the <br />AML Program for access to the old utility road for purposes of <br />reclamation, the final placement of this fabric will be delayed <br />till spring 1994. Laying of the geotextile fabric does not <br />constitute an abatement step as defined in the original NOV, rather <br />it is an additional insurance against erosion in the final <br />reclamation plan for the pile as outlined in the Technical Revision <br />submitted as abatement for the NOV. <br />Termination⢠<br />Therefore, the NOV was terminated since the operator had <br />accomplished all that was at this time, possible to address the <br />concern outlined in the NOV, mainly surface water drainage off the <br />pile. The abatement steps for the NOV have been accomplished - <br />submit a Technical Revision addressing the drainage off the pile <br />and implement the revision. <br />In addition to submitting the TR, the operator had previously <br />constructed a dirt berm at the toe of the refuse pile, thus <br />allowing the surface flow to exit to the drainage ditch and into <br />the upper bench sediment pond. This interim abatement step was <br />made on July 16, 1993 and remained in effect until actual <br />reclamation of the refuse pile began in mid-January 1994. <br />
