Materials Processing Center under Asphalt Plant Lease. Commencing in January <br />1, 2007, and through the remainder of the term of the Asphalt Plant Lease, as it may be extended <br />hereunder, Tenant may use that portion of the real property descn'bed on Ezhibft A hereto described <br />on Exhibit D hereto as "Conveyor ROW" and "Materials Processing" for conveying rnateriaLs by <br />conveyor and processing materials from anoff-site source.--The Asphalt Plant Lease will ap~.ia. <br />and affect that portion so indleated on Exhibit D attached hereto containing approximately}yl'acres. <br />The parcel ofproperty described on Exhibit D (as to the Asphalt Plant Lease) hereto is also referred <br />to herein as the "Premises", both collectively with the Concrete Plant Lease and separately with <br />respect to either particular Lease. The monthly Base Rent payable pursuant to Section 3(x)(1) ofthe <br />Asphalt Plant Lease shall be increased for the added Materials Processing Premises commencing <br />January 1, 200'1 by the following annual amounts (in addition to amounts payable under Paragraph 6; <br />above): <br />Time Period Moa y Base rent <br />2007 $8,750.00 <br />2008 $10,000:00 <br />2009 $11,250.00 (if Tenant exercises the option to extend the <br />feria of the Asphalt Plant Lease). <br />2010 $12,500.00 (if Tenant exercises the option to extend the <br />term of the Asphalt Plant Lease) <br />Payments of such additional Base Rent aze due and payable in mondtly installments of one-twelfth <br />(1/12) of the above amounts on the first day of each month during the term, as may be extended, <br />commencing January 1, 2007. Payment of the foregoing amounts in this Paragraph '7, commencing <br />January 1, 2007, shall also entitle Tenantto access to all of the Premises described in Exhibit E for <br />the purpose of performing and completing all reclamation required of Tenant for lands mined or <br />disturbed by operations under the Mining Lease, the Concrete Plant Lease or the Asphalt Plant <br />Lease, and Tenant shall not be required to pay any separate amount under the Mining Lease in order <br />to be entitled to such access from and after January 1, 2007 while the Asphalt Plant Lease is in effect. <br />8. City of Fort Co1Gns Easements. The City of Fort Collins has commenced <br />condemnation, and Landlord is currently in negotiations with the City regarding grants, of property, <br />easements and rights of way across the property described on Exhibit A hereto, including property, <br />easements and rights of way for a relocation of Ziegler Road and various drainage, slope and utility <br />loooobao6.ooc:s}3 <br />
