1. Term of the Concrete Plant Lease. The term of the Concrete Plant Lease is extended from December 31, 2006, to December 31, 2008, provided that Tenant shall have the right to further extend the term of the Concrete Plant Lease to December 31, 2009 by notice to Landlord prior to August 1, 2008 and, if the Concrete Plant Lease is so extended, Tenant shall have the additional right to further extend the term of the Concrete Plant Lease to December 31, 2010 by notice to Landlord prior to August 1, 2009. 2. Premises for the Concrete Plant Lease. Ofthe rea] property described on Ezhibit A hereto, the Concrete Plant Lease will apply to and affect only that portion indicated as "Concrete" on Exhibit B attached hereto containing approximately~c~res. The parcel of property described on Ezhibit B (as to the Concrete Plant Lease) hereto is referred to herein as the "Premises", both collectively with the Asphalt Plant Lease and separately with respect to either particular Lease. 3. Base Rent for the Concrete Plant Lease. The montlily Base Rentpayable pursuant to Section 3(x)(1) of the Concrete Plant Lease commencing January 1, 2006 will be as follows: Time Period Monthly Base rent 2006 $7,500.00 2007 $8,750.00 2008 $10,000.00 2009 $11,250.00 (if Tenant exercises the option to extend the term of the Concrete Plant Lease) 2010 12;500.00 (if Tenant exercises the second option to extend the term of the Concrete Plant Lease) Payments of Base Rent are due and payable on the fast day of each month during the term, as it may be extended, commencing January 1, 2006. 4. Term of the Asphalt Plant Lease. The term of the Asphalt Plant Lease is extended from December 31, 200b, to December 31, 2008, provided that Tenant shall have the right to further extend the term of the Asphalt Plant Lease to December 31, 2009 by notice to Landlord prior to August 1, 2008 and, if the Asphalt Plant Lease is so extended, Tenant shall have the additional right to further extend the term of the Asphalt Plant Lease to December 31, 2010 by notice to Landlord prior to August 1, 20U9. 5.
