WALSTRUM QUARRY OFFICIAL DEVELOPMENT PLAN <br />REZONING CASE #265, & <br />MAJOR PLAN AMENDMENT CASE #Ol-PDA-02 <br />AMENDED STIPULATIONS AND CONDITIONS <br />USES NORTH OF U.S. HWY. 6 <br />Uses pernutted are those as presented and shown in the Official Development Plan, these Stipulations and <br />Conditions, and as presented in the Amended Use and Area Regulations as presented on Page 2 of 6 of the Official <br />Development Plan. These uses include quarry and mine work as described on Page 2 of 6, and the location of one <br />maintenance and shop building located in the building envelope as shown on the site plan. The Planning <br />Department shall review the site plan and building plans for the proposed building prior to issuance of a building <br />permit Application fees shall reflect those of a Minor Plan Amendment for the Planning Department [o conduct <br />the review. The review shall encompass location of the structure to assure that it is hidden from vow from points <br />outside of the quarry. If [here is no practical area for the structure to be placed that is 100°/dhidderi from view, the <br />applicant shall demonstrate that the proposed location is the least visible location from points outside the quarry. If <br />the strucmre will be within view from points outside the quarry, the Planning Department shall review the site plan <br />and building plans in regards [o architectural features . The applicant shall demonstrate that the proposed stmcture <br />is compatible with the surrounding development, natural environment and general character of the area. <br />2. USES ON THE TEXACO PLACER (ALSO KNOWN AS STAGE Y) AND SOUTH OF U.S. HWY. 6 <br />Uses on the Texaco Placer shall include the following: <br />A. Employee parking in conformance with Section 14 (Off-Street Parking Requirements) of the Clear Creek <br />County Zoning Regulations. <br />B. Permit short term (no more than six (6) months) staging for mining equipment being moved into and out <br />of the quarry (no more than six (6) months per piece of equipment). <br />C. Pertni[ semi-trucks leaving the quarry to use this site [o secure their loads prior to entry onto U.S. Hwy. 6. <br />D. Landscaping, parking areas, staging areas and semi-truck load-securing areas shall be established as <br />presented on the Texaco Placer Site Plan. <br />Storage of aggregate and/or topsoil stockpiles, fines, etc. shall not be permitted on the Texaco Placer <br />Vegetation shall be established and maintained as presented on the Texaco Placer Site Plan. <br />A silt fence shall be installed by 1 May 2002 along the entire southern property line to limit the amount of sediment <br />and material falling into Clear Creek. The fence shall remain and continue to be maintained until there is a 80% <br />success rate of vegetation on the Texaao Placer as per an inspection conducted by the Si[e Development <br />Department. <br />The applicant shall revise the Stage Y Landscaping Plan by adding additional vegetative cover in the areas around <br />[he catch basin (detention basin), the parking apron and proposed 10-foot wide planting bed up to, at least, the <br />midpoint of the length of [he parking apron. <br />The 10-foot wide planting bed shall continue along the eastern property line in place of the proposed straw bale <br />barzier as shown on the Stage Y Landscaping Plan. <br />3. ACCESS BY COLORADO DIVISION OF WILDLIFE <br />Right and privileges of access to the property are hereby granted to the Colorado Division of Wildlife, subject to <br />their checking with the mine superintendent or owner and being properly equipped to meet all Mine, Safety & <br />Health Adnainistra[ion (MSHA) safety standards prior to entering the mine, for purposes of monitoring and <br />evaluating progress relative to revegetation and restoration of wildlife habitat. The owners have agreed, and shall <br />participate with [he Colorado Division of Wildlife to help mitigate wildlife concerns regarding road-kill issues. <br />4. ACCESS BY ADJACENT PROPERTY OWNERS <br />Right and privileges of access are hereby granted to the owners, and to telecommunication companies with <br />telecommunication facilities located on adjacent sites, including Clear Creek County, subject to their checking with <br />the mine superintendent or owner and being properly equipped to meet all Mine, Safety & Health Administration <br />(MSHA) safety standards prior to entering [he quarry. - <br />5. TELECOMMUNICATIONS FACILITIES NOTIFICATION <br />The applicant shall notify all telecommunications companies that have telecommunications facilities located on the <br />land on which they must use this property for access, and an alternate route to the telecommunication facilities shall <br />be secured prior to the destruction of the existing route leading to the facilities that is adequate to the owners of the <br />telecommunications facilities. <br />6. POWER LINES <br />All power lines and easements shall be appropriately moved and/or altered prior to mining the new portion of this <br />Official Development Plan. <br />7. STAGE X <br />Expansion of the quarry shall not occur until Stage X has been cleaned up and reclaimed as per [he Mined Land <br />Reclamation Board's Reclamation Permit for this property. <br />8. BLASTING <br />Blasting will only occur between [he hours of 9:00 a.m. and 4:00 p.m. All blasting shall be conducted in <br />conformance with the quarry's Blasting Vibration Control Plan as required, adnunistered and enforced by the <br />Colorado Division of Minerals and Geology. <br />
