All aspects of my involvement with the Eagle Pit permit application, including attendance at the March 1, 1979 Mined Land Reclamation Board meeting, were undertaken solely in my capacity as an officer and employee of Nottingham Sand and Gravel Company. 6. I have never had any personal involvement, interest or participation in the Eagle Pit permit application of Nottingham Sand and Gravel Company, apart from the role I played as a corpo- rate officer and employee. 7. Nottingham Sand and Gravel Company purchased the land included in the Eagle Pit permit application from the Brush Creek and Eagle River Company. A copy of the deed from the Brush Creek and Eagle River Company has been attached and marked as Exhibit 1, 8. When the Brush Creek and Eagle River Company sold the property covered by the Eagle Pit application, Brush Creek re- tained the adjoining land. Notice of the Eagle Pit application was, therefore, sent by certified mail to the Brush Creek and Eagle River Company at P.O. Box 242, Eagle, Colorado 81631. The letter to the Brush Creek and Eagle River Company containing notice of the application which was sent by our representatives is attached and identified as Exhibit 2. The notice was received and accepted by Mr. Robert Stemwedel as shown by the return re- ceipt attached to Exhibit 2. 9. Nottingham Sand and Gravel Company also arranged for publication of notice of the Eagle Pit permit application in the Eagle Valley Enterprise on a weekly basis for four consecutive weeks. A copy of the proof of publication of the notice is at- tached and marked as Exhibit 3. 10. On March 1, 1979 I attended a meeting of the Mined Land Reclamation Board at which the Nottingham Sand and Gravel application was considered by the Board and was present during the -2-
