.~ <br />FAULT <br />The operator has indicated that approved construction practices were followed in improving a <br />pre-existing road. However, the mine permit also indicates that best management practices will <br />be implemented to avoid disturbance of the stream channel and adverse impacts to water quality. <br />Placement of a berm in a flowing stream channel and, on top of a silt fence is not a best <br />management practice. The operator was negligent in not adhering to the permit commitment to <br />implement best management practices which were part of the basis for allowing a vaziance to <br />regulatory requirements for a stream buffer zone. $750 is assessed for a high degree of <br />negligence. <br />GOOD FAITH <br />There is no evidence of extraordinary measures taken to abate this violation. No credit for good <br />faith is being awazded at this time. <br />
