Mr. Randall Price
Colorado Mined Land Reclamation Division
January 13, 1995
Page 3
With regard to reference (3) as pertains to maintenance items of Pond 1, actions taken to abate
the violation address(ed) many of the maintenance problems. A summary of corrective actions
is presented in the following table:
Remediation of Maintenance Problems and Schedule, Pond 1
Maintenance Required Remediation and Schedule
Repair damage to the See Notice of Violation Abatement Actions described above. Gopher
embankment caused by burrows will be tamped in, and muskrat burrows uncovered and backfilled
rodent activity to maintain with compacted materials, concurrent with repairs to the upstream face of
the integrity of the dam. the dam (scheduled far completion as soon as ground conditions permit,
perhaps as late as Fall 1995). A raptor perch (pole) will be placed across
the pond from, and centered on, the dam during the construction work.
Should muskrats reappear on [he site, trapping and removal will be
conducted.
Repair damage to the See Notice of Violation Abatement Actions described above. These actions
upstream face of the will remediate the problem. (This work is scheduled to completed as soon
embankment caused by as ground conditions permit, perhaps as late as Fall 1995).
water (water line) action.
Reseed disturbed areas. During repair of the eroded upstream face of the embankment, the disturbed
and currently unvegetated areas other than the riprap zone will be seeded.
The seeding will be accomplished immediately after the construction items
(see Notice of Violation Abatement Actions) described above are completed
(scheduled to completed as soon as ground conditions permit, perhaps as
late as Fall 1995).
No maintenance problem requiring remediation action was identified with regard to Pond 2.
Monitoring of the (completed) revegetation effort (seeding of the downstream face of the dam),
and monitoring of the repaired cracks on the downstream face of the dam, will be items of
special interest in 1995 quarterly inspections. Should problems reappear, the additional actions
of seeding, fertilizing, and providing protection with an excelsior mat, and soil cement slurry
of the crack, will be accomplished as soon as ground conditions permit access with construction
equipment without undue disruption of reclaimed areas (historically, late fall). A raptor perch
(pole) will be placed near the dam during the construction work programmed for Pond 1
(scheduled to be completed as soon as ground conditions permit, perhaps as late as Fall 1995).
LE1.U91/J/[11.17 95B:45am)
