4) I normally do not make visits to the site in the winter since the site is always <br />snowed in and there is usually a large amount of snow. For this reason, I did not see <br />the files to find out that the last two submittals were not present in their proper <br />location. It is possible that a) the Clerk or assistant never received the materials, b) <br />they misplaced the materials after arrival or c) someone asked to see the file and either <br />removed or misplaced the material. There is no way to prevent the third possibility. <br />Other circumstances that should be considered in this case are: <br />I) Once you advised my of the problem, I was still in New York and since my father <br />was making a recovery, I flew back to Denver on the night of January 30. I got home <br />from DIA at 11:30 at night and I stayed up until 2:00 AM re-copying all the inspection <br />reports since 9/99, NPDES DMR's, sediment pond inspections and I filled out aFED- <br />Ex form, placed the copied material with a copy of the insurance policy that you sent <br />me as well as a letter to the County Clerk asking for confirmation that they received <br />this package. The package was mailed the following afternoon. I copied the cover sheet <br />and faxed it to you with the cover letter to the Clerk. They did send me an a-mail <br />confirmation two days later. This material is also enclosed and it is well before the <br />abatement date. <br />2) I have diligently worked with the DMG for years on this mine as well as many <br />others and have had very few, if any, problems. <br />Overall, I believe it was a combination of unfortunate circumstances that resulted in <br />the materials not being present in the County file. I hope that this information is taken <br />into account, and I can say unequivocally that this mishap will never happen again.
