' <br />Albuquerque, New l~lexico 87102 <br />Re: fen-Day Notice IVO. 83-2-U-2 <br />File No. C-U2U-81; f4unger Canyon Mine <br />Uear Mr. Ehmett: <br /> <br />The Mined Land.Keclaination Uivision received the above-referenced Ten-Uay <br />Notice on June 2, 1983. The Division feels that no action is necessary <br />on the three parts of the Ten-Uay fJotice for the reasons outlined below. <br />The Mined Land Reclamation Uivision is aware that Salt Creek hlining <br />Company has not inet the schedule proposed in Table 2.2-1 of the permit <br />application. Construction of the upgraded structures has been delayed <br />due to unfavorable economic conditions. The Uivision feels that it is <br />unpractical to update the time schedule whenever a mining operation falls <br />behind schedule. If a mining operation were ahead of the proposed <br />schedule, the Division would be concerned because the mining operation <br />might have a greater impact on the environment than anticipated. <br />Conversely, if a mining company is behind schedule, environmental impacts <br />should be less than anticipated. The Division feels that it is only <br />necessary to update the schedule during the mid-term review, 2 1/2 years <br />following permit issuance, if the operation is behind schedule. <br />Failure to adhere to the road and Dench paving schedules and sign posting <br />1 requirements were specifically noted in the Ten-Uay Notice. Before the <br />1 ~ haul road and the mine bench can be paved, these structures must be <br />upgraded. The present road into the site is not the upgraded haul road, <br />and the present bench is not in its completed configuration. Also, all <br />~ signs required for the INunger Canyon Mine in its present configuration <br />are present. Ns previously mentioned, the Uivision is not concerned that <br />Salt Creek Mining Company is behind schedule, as there are no resultant <br />environmental impacts. <br />The second part of the Ten-Uay Notice involved failaure to maintain the <br />berTn at the Loma Loadout. Un June 7, 1983, Michael Savage, of the Mined <br />Land Reclamation Uivision, conducted an inspection at the loadout.
