Staff Recommendation:
Violation: Find a violation of Amendment AM-002 to Permit No.
M-83-084 and to the Colorado Mined Land Reclamation
Act, C.R.S. 34-32-101 et seq. and specifically
C.R.S. 34-32-116(1) for failure to perform such
reclamation as is prescribed by the reclamation
plan.
Cease and Desist:
Recommended for all mining and processing
activities. Cease and Desist would not apply to
any activities necessary to bring the site into
compliance with the approved permit.
Corrective Actions:
1.) No later than April 30, 1996; either backfill the pit to
the approved maximum size of 2.1 acres or submit a
complete amendment to the permit. This needs to
include revised mining and reclamation plans and maps
which increase the maximum allowable pit size and
provide plans for reclaiming all areas disturbed by the
mining operation including the pits and settling ponds.
2.) Get the amendment approved by no later than July 30,
1996 if there are no objectors and by August 30, 1996 if
there are objectors.
3.) Within 45 days from today's Board hearing date, either
fence the pit area to control access or reduce all
slopes to no steeper than 2H:1V.
Civil Penalty Range $100-$950 per day. If $50 a day is added
for history, daily penalty may not exceed $950 + $50:
12-12-95 due date to backfill pit to 3-27-96 = 105 days
$100-$950/day x 105 days = $10,500.00 = $99,750.00
