' ~ ~ -~ ~ <br />~P <br />~' ~- . <br />M-83-084 Snowstorm Placer <br />Seriousness: Zones <br />D ~ B A <br />(A) Administrative Violation, or Some On-Site Damage <br />(B) Little Off-Site Damage, Moderate On-Site Damage, No <br />Health or Safety Hazard <br />(C) Little Off-Site Damage, Significant On-Site Damage, <br />and/or Possible Health or Safety Hazard <br />(D) Off-Site Damage, and/or Significant Health or Safety <br />Hazard <br /> <br />History of Violations in Past Twelve Months: None <br />Staff Recommendation: <br />Violation: Find a violation of Amendment AM-002 to Permit No. <br />M-83-084 and to the Colorado Mined Land Reclamation <br />Act, C.R.S. 34-32-101 et seq. and specifically <br />C.R.S. 34-32-116(1) for failure to perform such <br />reclamation as is prescribed by the reclamation <br />plan. <br />Cease and Desist: <br />Recommended for all mining and processing <br />activities. Cease and Desist would not apply to <br />any activities necessary to bring the site into <br />compliance with the approved permit. <br />Corrective Actions: <br />1.) No later than April 30, 1996; either backfill the pit to <br />the approved maximum size of 2.1 acres or submit a <br />complete amendment to the permit. This needs to <br />include revised mining and reclamation plans and maps <br />which increase the maximum allowable pit size and <br />provide plans for reclaiming all areas disturbed by the <br />mining operation including the pits and settling ponds. <br />2.) Get the amendment approved by no later than July 30, <br />1996 if there are no objectors and by August 30, 1996 if <br />there are objectors. <br />3.) Within 45 days from today's Board hearing date, either <br />fence the pit area to control access or reduce all <br />slopes to no steeper than 2H:1V. <br />Civil Penalty Range $100-$950 per day. If $50 a day is added <br />for history, daily penalty may not exceed $950 + $50: <br />12-12-95 due date to backfill pit to 3-27-96 = 105 days <br />$100-$950/day x 105 days = $10,500.00 = $99,750.00 <br />C:\WP51\83-084\RECL-BRD.FRM <br />Page 2 of 2 <br />
