Dep. <br />New bond calculations performed on 11-1-95 and sent to <br />the operator on 11-17-95 indicate that this bond amount <br />is not sufficient. Bond re-calculated at $175,815.00. <br />Nature and Duration of Violation: <br />11-15-90 Amendment 001 approved. Phased mining plan and <br />concurrent reclamation to include backfilling the pit <br />with sediment pond tailings. Maximum pit disturbance <br />allowed = 6 acres at any one time. <br />3-27-91 Hoard conditionally approved Amendment 002. <br />Mining plan revised to reduce the maximum pit <br />disturbance to 2.1 acres. This was done to reduce the <br />required financial warranty amount. Reclamation <br />concurrent with mining by backfilling, replacing topsoil <br />and reseeding. Maximum size of active pit revised to <br />2.1 acres, bond amount based on 2.1 maximum pit size. <br />4-3-95 Permit transferred to Zigan Sand & Gravel Inc. <br />9-28-95 DMG inspection: <br />Possible Violation- Failure to follow reclamation plan: <br />Active pit exceeds maximum size and Concurrent <br />reclamation not being conducted. <br />Corrective Action - By 12-12-95 either backfill pit to <br />2.1 acres or submit revision which includes revised <br />mining & reclamation plans. <br />i1-17-95 DMG notified the operator that the bond had been <br />recalculated for all mining related disturbance to <br />$175,815.00. Operator given to 1-16-96 to submit <br />required bond amount. <br />12-22-95 Operator's response to 9-28-95 inspection report. Plans <br />to submit plan to increase the area of severe <br />disturbance but needs more time. <br />12-26-95 DMG inspection: No changes on-site regarding reduction <br />of active pit to maximum allowable size of 2.1 acres. <br />DMG had not received a revision to the permit. <br />Corrective Action dates for backfilling pit or <br />submitting an amendment extended to 4-30-96 (returned <br />unclaimed on 3-4-96). <br />1-19-96 Reason to believe notices sent to operator. <br />1-23-96 Operator re-noticed for March Board. <br />Page 1 of 2 <br />
