-13- <br />30. FORMAL PUBLIC HEARING <br />Update on Rule-making, Board Member Stewart provided <br />information about the process. She said a variety of people <br />have been participating in the rule-making which was initiated <br />about a month ago. <br />The purpose of this rule-making is for the Board to adjust <br />rules and establish statutes to support SB 247. The issue of <br />administrative housekeeping or modification of other rules <br />evolved during this process. <br />The Division committed to initiating a secondary rule-making <br />process to cover issues that were not involved with SB 247, <br />after completion of the current rule-making session. It is <br />anticipated that current rule-making will be completed by <br />January of 1994. <br />31. NPs AND CONTINUANCES APPROVED <br />32. FORMAL PUBLIC HEARING <br />GEMINI ENERGY AND MINERALS CORPORATION File No. M-78-299 <br />Consideration of a possible notice of violation, cease and <br />desist order, corrective actions and civil penalties for <br />mining related activities outside the permit boundary. <br />The Division experienced difficulty in its attempts to contact <br />the operator regarding the need to address some problems noted <br />at the site. Staff said the operator is out of the country <br />this week, but would like to meet with the Division onsite <br />next week, in order to discuss the problems at the site. The <br />Division concurred with the operator's request for a <br />continuance of this matter. <br />The Board granted the operator's request and continued this <br />matter to the November 1993 Board Meeting. <br />33. FORMAL PUBLIC HEARING <br />GEMINI ENERGY AND MINERALS CORPORATION File No. M-78-299 <br />Consideration of a possible notice of violation, cease and <br />desist order, corrective actions and civil penalties for <br />failure to stabilize the south wall of the west or upper <br />sediment pond. <br />As with Item 32, the Board granted the operator's request and <br />continued this matter to the November 1993 Board Meeting. <br />
