-12- <br />The Board recommended that the Town obtain a (111) permit for <br />the proposed activity, in order to address their concerns <br />about reclamation of the site. <br />The Board found that the operator's activity does not clearly <br />meet: the definition of an exemption from the need for a <br />pe rn1it, and the request for a Declaratory Order was denied. <br />•2. CELESTA ADAMS File No. N/A <br />Con:~ideration of a request for a Declaratory Order exempting <br />the export of excess material resulting from the cleaning of <br />a pond for use in road construction on a separate property <br />from the requirement of obtaining a State reclamation permit. <br />Ms. Mary Seifert addressed the Board on behalf of the <br />operator. She explained the proposed activity and answered <br />questions from the Board. <br />The Division's and Board's opinion was that the proposed <br />activity would not be considered mining. It was felt that <br />removing the material and reseeding the area would be <br />preferred to leaving the site as it is currently. <br />The Board found that the operator's activity, as described <br />today, would not be considered mining and, therefore, would <br />not require a State reclamation permit. <br />+1. DISCUSSION ITEM <br />Consideration of adoption of new Minerals Program forms, <br />Transfer of Mineral Reclamation Perrnit and Succession of <br />Operators application. <br />Staff asked that the Board continue this matter to its <br />November 1993 Meeting, in order to allow the Division more <br />time to review this issue. <br />The Board continued this matter to the November 1993 Board <br />Meeting. <br />
