Three <br />exceedences are reported for the period. The 30-day average and daily maximum total suspended solids (TSS) <br />limitations for Outfall 005 were exceeded along with the 30-day average total recoverable iron (TRFe)limitation. <br />All three Outfall 005 exceedences are attributable to a waterline break which occurred on February 19, 1996. This <br />break temporarily caused additional sediment to be transported to the sampling point for Outfall 005 and resulted in <br />a collected sample exhibiting extremely high TSS and TRFe values. These values exceeded the daily maximum <br />limitations and raised the monthly average levels as reported. <br />Cyprus Yampa Valley Coal Corporation (CYVCC) believes this situation meets the definition of an upset as <br />described in the permit, and had this situatiuon not occurred, compliance would have been maintained at the ou[fall <br />throughout the reporting period. However, CYVCC failed to meet the noncompliance notification requirements <br />necessary to claim an upset condition az the realization of the waterline break's contribution to [he exceeded levels <br />occurred more than 24-hours after CYVCC became aware of the noncompliance and CYVCCwas therefore unable <br />to meet the specified reporting time frames required by the permit in order to claim an upset. In the alternative, <br />exceedences are reported based upon the values obtained using the sample azsociated with the waterline break. <br />CYVCC remedied the problem immediately upon becoming aware of the break and compliance was reestablished at <br />this ou[fall as documented by a sample collected on March 4, 1996. <br />Alternative limitations are claimed for Pond B. Outfall 003A for a reported 30-day average and daily maximum TSS <br />result of 202 mg/I. The 30-day average and daily maximum SS result of 0.5 mg/I is reported and within permit <br />limitations. Rainfall less than the 10-year, 24-hour precipitation event was recorded at USGS station 09243900 for <br />February 19 and 20, 1996 as indicated in the following [able. The sample was collected for Ou[fall 003A on <br />February 20, 1996.
