BMG's preliminary suspicions of altered met llic ore <br />content, and the coincidental failure of the designed processi g cyanide <br />recovery circuit, are additional indications of a modification in the <br />tailings chemical constituency. If the chemical constituency f the <br />tailings is different than the original projections, the proje ted <br />characterization of the tailings as non-toxic and chemically i ert is <br />suspect. Change in the tailings constituency may render the a proved <br />final reclamation plan for the tailings inappropriate. <br />In light of any information developed by BMG in the course of jts <br />required investigations, analyses and redesign, including any <br />modification to its processing methodology, 8MG shall modify i s tailings <br />area detoxification and reclamation plans appropriately. Appr priate <br />applications, supported by comprehensive analytical results an design <br />evaluations, shall be submitted by BMG to the Division for rev ew and <br />approval no later than 180 days following completion of the cy Hide <br />detoxification of the tailings areas contents, described in it m (4) <br />above. <br />Status: Satisfied - BMG has committed to the completion of th requested <br />investigations, the submittal of a compre ensive <br />report, and the submission of appropriate permit <br />modifications, if necessitated, in a Lett r of April <br />16, 1992. The Division originaily specif ed <br />submittal within 90 days following detoxi ication, <br />however, BMG has demonstrated that 180 da s will be <br />required to complete the requested evalua ion. <br />(9> Modification of Environmental Monitoring Plan: <br />BMG shall modify its environmental monitoring plan to include irect <br />monitoring of the cyanide and metals content of the tailings s urry and <br />liquids. Within 15 days following the cyanide detoxification f the <br />tailings area contents, described in item (4), BMG shall submi sampling <br />methodology, sampling locations and sampling protocol for tail~ngs <br />cyanide and metals content monitoring to the Division for revi w and <br />approval. <br />Further, BMG shall appropriately modify its entire environment 1 <br />monitoring plan, including ground and surface water, air, and processing <br />circuit monitoring, to reflect all modifications completed in ompliance <br />with these NOV abatement requirements. These modifications sh~ll be <br />submitted in connection with the various permit revision applications. <br />Status: Satisfied - 8MG has committed to the submittal of a r~vised <br />monitoring program in a letter of April 16, 1992. <br />Mav Progress: - Submittals BMG made in response to Abatement <br />Requirements ,~4, t16 & //12, also address this <br />Abatement Requirement. <br />
