YES <br />DIVISION'S REASON FOR BRINGING THIS TO THE BOARD AS MINING WITHOUT A PERMIT <br />VERSUS MINING OUTSIDE THE PERMIT BOUNDARY <br />(DMG Policy -For any 110 type operation, if the operator affects greater than two acres, the operator shall be <br />found for mining without a permit. For all other permitted operations, mining without a permit shall be <br />determined on a case-by-case basis. Items to consider include the amount of disturbance, type of disturbance, <br />ownership of the disturbed area, impact to the sun•ounding area due to the disturbance, degree of any health or <br />safety hazazd.) <br />NATURE OF UNPERMITTED (Construction Materials Extraction C.M.E..) <br />Est. Ac. outside permit boundary : NA <br />SERIOUSNESS <br />Operator conducted activity on own property Yes, and the minerals are owned by the federal government. <br />Site activity, describe: There was not any activity occurring during the disturbance. There was a generator and <br />a tractor on site. There appeazed to be recent mining activity onsite. <br />Area wide impacts, describe -The disturbance at the possible illegal mine is made up of a quarried area and <br />areas where sandstone is worked and stored. The disturbance area is approximately 420 feet by 480 feet (4.6 <br />Ac). While there may have been some historic mining at this site, it appeazed that a majority of mining activity <br />had occurred recently. <br />The quarried area is approximately 1.5 acres and ranges in depth from two to five feet. The sandstone bedding <br />is roughly parallel to the nearly horizontal surface topography. <br />Overburden, waste rock, woody debris, and topsoil were scraped up and placed in several piles around the pit <br />to a height of 5 to 10 feet. <br />The sandstone is placed on pallets, or is loosely piled on the ground around the site. The sandstone sheets <br />range from a foot square to greater then 20 squaze feet. Approximately 3 acres of land surrounding the quarry <br />had sandstone stored on it. <br />
