<br /> <br /> <br />-2- <br />2. <br />3. <br /> <br />Mail, within one (1) day after receipt of this Notice, to the Mined Land Reclamation Boazd, <br />written notice of your compliance with pazagraph one (1) of this Cease and Desist Order. <br />Complete the following corrective action: <br />The operator must obtain an appropriate permit for this site. A I10(2) permit <br />application was submitted on August 24, 1995. Approval must be obtained within 60 <br />days of submittal (by October 23, 1995). <br />4. Pay the Colorado Mined Land Reclamation Boazd a civil penalty in the amount of $50.00, <br />within 30 days of the signature date of this document. This is based upon an assessment of <br />550.00 per day for one day of violation. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. <br />In clazification of the righu of recipienu of Notices of Violation, Cease and Desist Orders, parties are <br />advised to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure <br />Aa. <br />Nothing herein contained, particulazly those portions requiring certain acts to be performed within a <br />certain time, shall be construed as a permit or license to engage in any prospecting or mining <br />operations within the State. <br />Persons concerned with judicial review of the provisions of this Order aze advised to consult <br />C.R.S. 24-4-106, as amended. <br />Dated at Denver this ya~~ <br />day of S <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
