Box 100 ) AND <br />San Luis, CO 81152 ) CEASE AND DESIST ORDER <br />TO: Costilla County and all other persons engaged in or owning or controlling the following <br />operation: Sierra Grande Site, located in Costilla County, as described below. <br />FINDINGS OF FACT <br />Pursuant co the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 34-32-123 and 124, the Board hereby makes the following findings of fact: <br />1. Costilla County is conducting a mining operation in the following location: Section 21, <br />Township 305, Range 72W of the 6th P.M., in Costilla County, Colorado. <br />2. On Ottober 25, 1994, the Mined Land Reclamation Board issued a Cease and Desist Order <br />prohibiting further mining activities at the Sierra Grande Site, included as part of Notice of <br />Violation No. M-94-050. <br />3. The Mined Land Reclamation Board condutted a Formal Public Hearing on August 24, 1995 <br />to consider possible violation of the above-mentioned Board Order, and C.R.S. 34-32-101 et sec . <br />4. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on <br />August 24, 1995, demonstrating that the operator was mining at the Sierra Grande Site, in <br />violation of the Board Order. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with C.R.S. 34-32-124(6), the Colorado <br />Mined Land Reclamation Board hereby finds Costilla County to be in violation of Notice of Violation <br />M-94-050 and C.R.S. 34-32-124(2)(a). <br />CEASE AND DESIST ORDER <br /> <br />Based upon these same Findings of Fatt and Notice of Violation, and in accordance with <br />C.R.S.34-32-124(2),(6) and (7) the Colorado Mined Land Reclamation Board hereby orders <br />Costilla County to: <br />1. Cease and desist from conducting all mining operations at the Sierra Grande Site, <br />File No. M-94-103, until all corrective actions are completed. <br />
