Box 100 ) AND San Luis, CO 81152 ) CEASE AND DESIST ORDER TO: Costilla County and all other persons engaged in or owning or controlling the following operation: Sierra Grande Site, located in Costilla County, as described below. FINDINGS OF FACT Pursuant co the authority vested in the State of Colorado Mined Land Reclamation Board by C.R.S. 34-32-123 and 124, the Board hereby makes the following findings of fact: 1. Costilla County is conducting a mining operation in the following location: Section 21, Township 305, Range 72W of the 6th P.M., in Costilla County, Colorado. 2. On Ottober 25, 1994, the Mined Land Reclamation Board issued a Cease and Desist Order prohibiting further mining activities at the Sierra Grande Site, included as part of Notice of Violation No. M-94-050. 3. The Mined Land Reclamation Board condutted a Formal Public Hearing on August 24, 1995 to consider possible violation of the above-mentioned Board Order, and C.R.S. 34-32-101 et sec . 4. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on August 24, 1995, demonstrating that the operator was mining at the Sierra Grande Site, in violation of the Board Order. NOTICE OF VIOLATION Based upon these same Findings of Fact and in accordance with C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds Costilla County to be in violation of Notice of Violation M-94-050 and C.R.S. 34-32-124(2)(a). CEASE AND DESIST ORDER Based upon these same Findings of Fatt and Notice of Violation, and in accordance with C.R.S.34-32-124(2),(6) and (7) the Colorado Mined Land Reclamation Board hereby orders Costilla County to: 1. Cease and desist from conducting all mining operations at the Sierra Grande Site, File No. M-94-103, until all corrective actions are completed.
