In addition to <br /> 5 that, Mrs. I<ay Webster, the deceased's surviving <br /> 6 spouse also filed a claim for an equitable interest <br /> 7 in the Plebster Sand and Gravel operation at Tennessee <br /> 8 Pass. Because she is the personal representative of the <br /> 9 Estate, she cannot act on her own claim. So pursuant to <br /> 10 statute, an application was made in the Lake County <br /> 11 District Court requesting the Court appoint a special <br /> 12 administrator. for the purpose of examining both her <br />• 13 claim and the decedent's claim relative to the Tennessee <br /> 14 Pass pit in making a recommendation to the Court concerning <br /> 15 the propriety of the claim or claims. <br /> 16 The Court appointed hlr. John Peoples who <br /> 17 is a businessman and appraiser in Salida, Colorado, as <br /> 1S the special administrator. For reasons which I cannot <br /> 19 defend nor relate to the board, Mr. Peoples hasn't <br /> 20 pursued the matter as expeditiously as we had all hoped <br /> 21 and as of this date, we do not yet have his report and <br /> 22 recommendations concerning the status of those claims. <br /> 23 The last order entered by the Court allows him until <br /> 24 December 30 within which to file his report and recommenda- <br />• <br /> 25 tions.
